slowly digital membership

  • Fees are $19 AUD per week per user, charged in either monthly terms at $39 per month, or charged for an annual (12 month) term at $390 per year. After the initial term the membership will automatically rollover into another term of the same length unless you cancel beforehand.

  • If you want to cancel your subscription you can do so from your Account, (click Account > Memberships), accessed via https://slowly.com.au when logged in as a member.

  • If your subscription is past due or expired, you can navigate to the Account > Memberships tab and click Renew Now. Next, you can update your credit card details if required and renew your subscription.

  • If you cancel part way through a term of active subscription then the membership will cease all your future scheduled billings starting from the next upcoming billing date in your cycle.

  • This membership is available for users outside the USA and Canada only.

  • No refunds or transfers are offered on the Slowly Digital Membership for any reason.

  • Memberships may not be shared or transferred for any reason at any time. Anyone sharing memberships does so expressly without the consent of Here Collective and will be denied all future access and forfeit their membership.

Agreement

1. In consideration of participating in the Services, I agree and acknowledge that I am fully aware that participation in the Services involves Risks and I accept all the Risks of participating in the Services, even if the Risks are created by the carelessness, negligence or gross negligence of a Released Party or anyone else.

2. I agree and acknowledge that:

a. I am in proper physical condition to participate in the Services, and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death.

b. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured.

c. I will gain medical clearance from my physician prior to participation in the Services if I have any of the following conditions:

i. Heart disease
ii. Epilepsy
iii. Shortness of breath
iv. Chest pain
v. High blood pressure
vi. Low Blood pressure
vii. Pain of any kind including but not limited to bone pain or joint pain or muscle pain or back pain
viii. Abnormal resting EKG
ix. Diabetes
x. Pregnancy
xi. Any other condition or injury or illness not listed above

d. I will not participate in the services while under the influence of any medications or drugs that I may be taking prescribed or otherwise, unless instructed otherwise by my physician.

3. I am aware that it is advisable to consult a physician prior to participating in the Services. If I have consulted a physician, I have taken the physician’s advice.

4. I hereby, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any and all rights or Claims I may have, now or in the future, against any Released Party, even if the Claims are based on the carelessness or negligence of a Released Party or anyone else. Without limiting the foregoing, I further release any recourses which I may now or hereafter have resulting from any decision of any Released Party.

5. I agree not to sue any Released Party for Claims, even if the Claims arise from the carelessness, negligence or gross negligence of any Released Party or anyone else. I agree to indemnify (reimburse for any loss) and hold harmless each Released Party from any loss or liability (including any reasonable legal fees they may incur) defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the carelessness or negligence of any Released Party or anyone else.

6. No warranties or representations have been made to me about the Services which are not stated on this form. I understand and intend that this document act as the broadest and most inclusive assumption of risk, waiver, release of liability, agreement not to sue and indemnity.

7. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

8. I have fully read and understand this agreement. I am aware that by signing this agreement, I am waiving certain legal rights I or my heirs, next of kin, executors, administrators and assigns may have against the Released Party.

9. In cases where the participant in the Services is under the age of 18 (eighteen) years old this agreement is accepted on the participant’s behalf by a parent or legal guardian and in doing so this parent or legal guardian gives consent to the minor’s participation in the Services.

10. I also understand that

a. All payments are non-refundable or transferrable for any reason, including, but not limited to vacation, illness and injury.
b. The scheduling and content of Services may be changed on occasion.
c. I will notify the Instructor or Health Practitioner immediately of any pain and/or major discomfort felt during the Services.
d. If I am pregnant or become pregnant or, I have consulted with my advising medical practitioner and have completed a health screening with them prior to participation in the Services (that require physical activity) and have obtained permission from my advising medical practitioner to participate in the Services and I will notify Slowly of my pregnancy status and changes to it prior to each participation in the Services.

By purchasing any product or service from www.slowly.com.au the purchaser, activity participant and recipient accept and agrees to the terms and provisions contained in this agreement.

Definitions

Service or Services means any activity or service conducted or facilitated by a Released Party including:

(a) an organised class, online class, exercise class or classes including, yoga or pilates or meditation.

(b) medical care or health care including the provision or receiving of psychological advice or treatment, or including the provision or receiving of physiotherapy advice or treatment, or including the provision or receiving of massage or soft tissue therapy advice or treatment.

Claims includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, personal injury or death in connection with participation in the Services.

Health Practitioner means a Psychologist or Neuropsychologist or Physiotherapist or Massage Therapist.

Here means Here Collective Pty Ltd ACN 166 339 242.

Slowly means Here Collective Pty Ltd

Instructor means a person who is certified to conduct or facilities a Service but who is not a Health Practitioner.

Physiotherapist means a physiotherapist registered with the Physiotherapy Board of Australia.

Psychologist means a psychologist registered with Psychology Board of Australia.

Released Party means Here or any of its affiliates, franchisees and their respective representatives, directors, officers, agents, employees or volunteer staff.

Risks means but is not limited to injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that, could cause serious disability.
